London U LLB - Honour Classification

(注意: 以下為筆者對Programme Regulations的理解，並不保證完全準確。若你要百份百準確的答案，可發電郵給London U)

最近有不少同學問，究竟多少分才能獲得一個London U的Second Up LLB。

其實這視乎你是否正在就讀London U LLB。是的話，適用於你的Regulations是Revised Regulations 2014-15，大家可於以下網頁瀏覽－

在該Regulations的第84頁可見，要取得一個Second Up的LLB，你需要-

方法一: 在9科當中最少5科考獲60-69分(或以上)，而9科的總分為505分或以上

方法二: 在9科當中最少4科考獲60-69分(或以上)，而9科的總分為520分或以上

請留意，兩者的平均分505/9=56.11 和520/9=57.78均低過60。

若果你正考慮報讀London U LLB的話，適用於你的Regulations是Programme Regulations 2015-16，大家可於以下網頁瀏覽－

在該Regulations的第12頁可見，要取得一個Second Up的LLB，你需要在Level 5和Level 6的Courses中，取得60-69分成績。

Level 5的Course只有: Tort Law

Level 6的Courses包括: Civil and Criminal Procedures, Commercial Law, Company Law, Equity and Trust, EU Law, Evidence和Property Law。

由此看來，在新Regulations下要獲得一個Second Up的難度似乎加大了。

PCLL Conversion Courses

前文「入讀PCLL的要求」和大家分享了如果想入讀PCLL，在讀LLB時，一定要修讀Tort, Contract, Constitutional Law, Criminal Law, Land Law, Equity。至於Civil Procedure, Criminal Procedures, Evidence, Business Associations, Commercial Law,申請人可以透過考Conversion Exam證明自己的Competency。

那麼有讀者可能會問，那麼我們是否必須報讀有關Conversion Courses的堂嗎? 答案是不用。Hong Kong Conversion Examination Board明確指出-

"Students who do not meet the above eligibility requirement for PCLL admission (按:請參閱前文「入讀PCLL的要求」) are not required to attend any conversion courses. There will not be any mandatory Conversion Courses. Students may prepare for the Hong Kong Conversion Examinations for PCLL Admission through self-study or attend courses to prepare themselves for the Conversion Examinations. The attendance at such courses is in itself insufficient to demonstrate competence in the Core Subjects or Top-up Subjects. "

就筆者所知，每年有不少在英國和澳洲當地修讀LLB的香港學生會在暑期或其他長假期間返港考Conversion Exams。大概是每次考一至兩科。在他們三年大學的暑期或其他長假期間便可以完成全部Conversion Exams。由於他們回港時間不多，他們大多以自修方式考畢Conversion。事實上Hong Kong Conversion Examin Board已將所有Past Papers, Exam Reports以至Reading Lists放在其網頁上，諸位的確可以自修－

然而，若你希望有人在旁邊講解一下，那麼去上Conversion Courses也未嘗不可。就筆者所知，現時開辦Conversion Courses的機構只有以下兩者－

1. HKU Space
2. IP Learning

HKU Space
現時HKU Space正開辦Hong Kong Land Law的課程。而Hong Kong Constitutional Law的課程將於8月17日開始。有意報讀的同學可參考其網頁－

至於Civil Procedures和Criminal Procedures，根據往績，HKU Space應在今年11月開辦有關課程。當中Civil Procedures的課程約為32小時，而Criminal Procedures約為24小時。但HKU Space方面未能明確回覆是否將於11月開辦這兩科的課程。有意報讀的同學可多留意其網頁。

Evidence的課程(約30小時)則可能於明年4月開辦。

根據IP Learning的網頁，它將於明年1月開辦以下各科的課程-

筆者並不清楚兩者有何優劣，若果大家曾報讀兩者的Conversion Courses，不如留言一起討論。

入讀PCLL的要求

一如前文「如何選Electives」中提及，在香港想當律師，讀完LLB(或CPE)是不夠的，還需要讀PCLL。

PCLL Core Subjects
要入讀PCLL一點也不容易，就London U LLB而言，起碼需要一個Second Up的LLB，還要證明自己"Competent in"以下十一科-

1. Contract
2. Tort
3. Constitutional Law
4. Criminal Law
5. Land Law  (i.e. Property Law)
6. Equity
7. Civil Procedure
8. Criminal Procedure
9. Evidence
10. Business Associations
11. Commercial Law

其中，Hong Kong Conversion Examination Board要求大家的Main Law Qualification一定要包括以下各科-

Tort, Contract, Constitutional Law, Criminal Law, Land Law, Equity.

這即是說申請人要證明自己"Competent in"這幾科，你在LLB時必須修讀有關科目。有人因此稱這幾科為"PCLL Core Subjects"或"PCLL Pre-requisite"。

可以透過考Conversion Exam證明Competence的五科
至於Civil Procedure, Criminal Procedures, Evidence, Business Associations, Commercial Law,申請人可以透過考Conversion Exam證明自己的Competency。這幾科的Conversion Exam一般一年舉辦兩次，一次在一月，另一次在六月。

然而大家不用考全部五科的Convesion Exam。若你在London U選修了某些Electives，你是可以獲得豁免考有關科目的Conversion的。詳情如下:

在London U修讀	可獲的PCLL Conversion Exam豁免
Commercial Law	Commercial Law (Part A) (見備註)
Company Law	Business Assosication
Civil and Criminal Procedures	Civil Procedures + Criminal Procedures
Evidence	Evidence

[備註:
大家可能看不明白"Commercial Law (Part A)"這點。

其實這是指PCLL Conversion Exam中的Commercial Law有三部份，分別為 Part A: Sale and Acquisition of Goods, Part B:  Personal Property和Part C: Part C: Consumer Credit and Protection。若果你修讀了London U LLB中的Commercial Law，你便不用考Part A。]

PCLL Top-up Subjects

如果PCLL申請人不是在香港三間法學院(港大、中大和城大)取得LLB，而是在其他普通法地區取得LLB(包括London U External LLB以至在英國當地或澳洲等地取得的LLB)，需要額外證明自己"Competent in"以下三科(稱為Top-up Subjects)-

1. Hong Kong Constitutional Law
2. Hong Kong Legal System
3. Hong Kong Land Law

實際上這三科，無論你在甚麼海外院校就讀，中間選修了甚麼Elective Law Courses，你都必須考該三科的Conversion Exams。

PCLL Conversion Exams
一如上述，各科的Conversion Exam一般一年舉辦兩次，一次在一月，另一次在六月。就2016年1月的考試而言，大家須在2015年8月31日前提交資料予Hong Kong Conversion Examination Board審批其法律資格，亦要於2015年11月16日前，向Hong Kong Conversion Examination Board報考。這個考試的合格標準是和LLB一致，因此有人說考試合格要角是Post-grad level，那是誤傳。你不信的話，請看這句-

"The standard of the examinations will be set and marked to be equivalent to the standard of an LLB degree awarded in HongKong."

收費方面，提交資料予Hong Kong Conversion Examination Board審批法律資格需付$1000。而Conversion Exam的收費是Core Subject (即Civil Procedure, Criminal Procedures, Evidence, Business Associations, Commercial Law)$2000一科， Top-up Subjects每科$1600。

你可能會問:我讀了London U LLB Commercial Law, 那我不用考Part A，只考Parts B&C。那收費是多少? 答應是每Part $800，考兩Part承惠$1600。

可以重考嗎? 可以。無限次。

一次可以應考多少科? 多次科也可以。

有規定要先考Evidence再考各他科嗎? 不用。考試次序由你話事。

諸位請看以下Hong Kong Conversion Examination Board的Informatoin Package的節錄-

"It is entirely within your discretion to decide the sequence of subjects in which you will be examined. There is neither a minimum nor maximum number of subjects that any student can attempt at any one session. There will be no limit on the number of students who can sit an examination at one time, and no limit on the number of attempts. The standard of the examinations will be set and marked to be equivalent to the standard of an LLB degree awarded in Hong Kong."

分享Past Papers

這幾天有一些讀者給我發電郵，問我有關Past Papers的問題。其實只要你登記成為London U學生，便可以在Student Portal中的VLE便可以下載。

不過筆者明白要自己下載再分類儲存好的話，實在要花點時間。

如何選Electives

最近收到讀書來函查詢有關選Electives的意見。我覺得這問題很好,所以特地寫了下文和大家探討一下選Electives問題。

我認為選Electives的考慮點主要有兩項。

考慮因素一: 分數

第一是分數問題。若你希望靠Electives拉高你的平均分,那你應該選比較容易高分的科目。這也是我當時選科的想法。就此我選了Commercial Law和Company Law。

以2013-14的May&June Exam為例:

Commerical Law Zone B共808人應考。當中只有59人(7%)不合格，180人(22%)人考獲40-49分，427人(53%)考得50-59分。至於60-69分也有142人(18%)。但沒有人考得70分以上。

Company Law這科共923人應考。當中92人(10%)不合格，286人(31%)人考獲40-49分，377人(41%)考得50-59分。至於60-69分只有163人(18%)。考得70分以上的有五人(1%)。

要了解這些數字，我們要先了解London U如何將其Degree Honour分類。根據其Programme Regulations的70分以上的為First Class，60-69分為Second Up，50-59分為Second Low，40-49分為Third Hon。40以下為不合格。

因此，選Commercial Law的人有71%考獲Second Low以上的成績。而選Company Law的人則有60%考獲Second Low以上的成績。

而Evidence Zone B則差很多了。這科共292人應考。當中64人(22%)不合格，83人(28%)人考獲40-49分，119人(41%)考得50-59分。至於60-69分只有26人(9%)。這麼難的一科當然沒有人考得70分以上。可見在這科考獲Second Low以上成績的學生只有五成。

而Civil and Criminal Procedures (該科考試不分Zone)的情況也不太好。這科共192人應考。當中34人(18%)不合格，83人(43%)人考獲40-49分，63人(33%)考得50-59分。至於60-69分只有11人(6%)。同時有一千零一人(1%)考得70分以上。在這科考獲Second Low以上成績的學生只有四成。

因此，純以分數考慮，大家應選修Commercial Law and Company Law。

考慮因素二: Exemption from PCLL Conversion Exam

大家知道，在香港想當律師，讀完LLB(或CPE)是不夠的，還需要讀PCLL。但要入讀PCLL一點也不容易，就London U LLB而言，起碼需要一個Second Up的LLB，還要證明自己"Competent in"以下十一科-

Civil and Criminal Procedures	Civil Procedures + Criminal Procedures
Evidence	Evidence

大家可能看不明白"Commercial Law (Part A)"這點。其實這是指PCLL Conversion Exam中的Commercial Law有三部份，分別為 Part A: Sale and Acquisition of Goods, Part B:  Personal Property和Part C: Part C: Consumer Credit and Protection。若果你修讀了London U LLB中的Commercial Law，你便不用考Part A。

Qualifying Law Degree
若果你想要一個能在英國當律師的LLB，那你需要選Qualifying Law Degree Route。選了該Route的話，你的其中一個Elective必須選EU Law。詳情見－

Non Qualifying Law Degree

若果你不需要一個能在英國當律師的LLB，你可以選Non Qualifying Law Degree Route。但要小心，若你選這Route，你必須選修-

Land Law (i.e. Property Law)

Equity 

這要求是由Hong Kong Conversion Examination Board訂的。所以若你不符合有關條件，不論港大、中大和城大的PCLL都不可能錄取你!詳情可見該機構網頁-

記著: 這兩科在Non Qualifying Law Degree Route中不再是必修科!沒有人提你必須修讀這兩科的。


建議
若果你要問我的意見的話，我會覺得Electives還是選Commercial Law　和／或　Company Law(當然若你行Non Qualifying Law Degree Route，請另外選Equity and Land Law)。因為我們大部人都不是打算當律師，考個好成績自然比其他考慮因素重要！

不過這只是我的個人看法而已！讀者還是要根據自身因素做決定！

另外，當London U這樣將其LLB分類後，香港的PCLL Providers可能會要求大家拿一個Qualifying Law Degree才能報PCLL。大家若真的有心報PCLL，在選Route前還是先問一下各大PCLL Providers (即港大、中大和城大)!
